AI & Data Limitations

• AI recommendations, nudges, and insights are generated from limited information and are not personalized medical, nutritional, or mental-health advice.
• The system cannot access your complete history, lab work, allergies, or prescriptions and may produce inaccurate, biased, or outdated information.
• All outputs must be verified with qualified professionals before use, especially for chronic conditions, pregnancy, or specialized training goals.

AI Food Scan & Nutrition Tools

• Barcode scans, photo-based ingredient recognition, and macro calculations rely on third-party databases and computer vision; misidentifications, incomplete labels, or missing allergen data can occur.
• Serving sizes, macros, and ingredient lists are estimates only and may differ from physical packaging or government databases.
• Images, UPC data, and label text can be securely transmitted to vetted AI processors solely to perform the requested recognition.
• Always read real packaging and consult professionals before consuming items, particularly when allergies, intolerances, or medical diets are involved.

AI Coach Chat & Behavioral Guidance

• Chat responses are machine-generated for education and habit support; they are not therapy, counseling, or individualized coaching.
• Conversations are not monitored in real time and cannot contact emergency or crisis services on your behalf.
• If AI guidance conflicts with licensed professional advice, follow the professional advice and discontinue the conflicting feature.

Terms of Service

1. Introduction & Acceptance

These Terms of Service ("Terms") govern your use of the MyPocketCoachAI mobile application, website, and services (collectively, the "App") operated by MyPocketCoachAI LLC ("MyPocketCoachAI," "we," "us," or "our"). By downloading, installing, creating an account, or using any feature—including AI Coach Chat, AI Food Scan, workout tracking, or HealthKit syncing—you agree to these Terms. If you do not agree, do not use the App.

2. Services & Features

• AI-powered workout, habit, and lifestyle recommendations.
• AI Coach Chat for educational prompts, accountability check-ins, and habit support.
• AI Food Scan for barcode scanning, nutrition label capture, macro estimates, and ingredient awareness.
• Body composition estimates, pose analysis, and computer-vision measurements.
• Progress tracking, journaling, streaks, reminders, and notifications.
• Health data syncing through integrations such as Apple Health / HealthKit or wearables you authorize.

3. Eligibility, Accounts & Security

• You must be at least 18 or have verifiable parental consent to use the App.
• Provide accurate information, maintain a secure password, and update details as needed.
• You are responsible for all activity that occurs under your account and must notify us immediately of unauthorized access or suspected misuse.

4. License & Intellectual Property

• We grant you a limited, revocable, non-transferable license to use the App for personal, non-commercial wellness purposes.
• All content, software, trademarks, and data are owned by MyPocketCoachAI LLC or its licensors. No rights are granted except as expressly stated.
• You may not copy, modify, reverse engineer, redistribute, or exploit the App or any AI outputs except as authorized.

5. User Content, Uploads & Feedback

• You retain ownership of photos, scans, diary entries, prompts, and other materials you submit but grant MyPocketCoachAI a worldwide, royalty-free license to host, process, and display that content solely to operate, secure, and improve the App.
• Do not upload content you lack rights to share, that includes personal data of others without consent, or that depicts minors without parental authorization.
• We may remove content or suspend accounts that violate these Terms, applicable laws, or safety policies.
• Feedback or suggestions may be used without obligation or compensation.

6. Prohibited Conduct

• Illegal, harassing, deceptive, or abusive behavior.
• Attempting to probe, scan, or test system vulnerabilities or bypass security.
• Scraping, bulk downloading, or creating derivative datasets from AI outputs.
• Using the App to provide medical advice, emergency triage, or professional services.
• Uploading malicious code, spyware, or content designed to manipulate AI models into harmful responses.

7. Health & Safety Obligations

• Consult licensed healthcare providers before starting new programs and verify any nutrition or exercise plan.
• Review real product labels before purchasing or consuming items surfaced by AI Food Scan.
• Stop workouts and seek care if you experience pain, dizziness, or other adverse symptoms.

8. AI & Automated Features

• AI Coach Chat, AI Food Scan, body analysis, predictive insights, and automated nudges rely on machine learning models that may change or be rate-limited for safety and compliance.
• Outputs may be incomplete, inaccurate, or inappropriate for your personal situation; you must apply independent judgment.
• By using these features you authorize us to transmit related text, photos, labels, and metadata to contracted AI processors as described in the Privacy Policy.

9. Health Data Integrations

• When you connect Apple Health / HealthKit or other wearable services, you control the categories of data shared.
• HealthKit data is used solely to provide or improve health and fitness features for you; it is not used for advertising, data brokerage, or shared with third parties except to operate the App or comply with law.
• You may disconnect integrations at any time but historical data already processed will remain subject to this Policy.

10. Payments & Subscriptions

• Certain features require auto-renewing subscriptions managed through the Apple App Store or Google Play. Fees, billing cycles, trials, and renewals are governed by the respective store’s terms.
• Subscriptions renew until cancelled at least 24 hours before the current period ends. Deleting the App does not cancel your subscription.
• We may modify pricing with notice permitted by the platform. Taxes and foreign exchange fees may apply.
• Refunds are handled exclusively by the app store; we cannot issue refunds directly.
• We may suspend or downgrade your account for unpaid charges, chargebacks, or suspected fraud.

11. Third-Party Services & Links

The App may link to third-party content, offers, recipes, or services. Those services have their own policies and we are not responsible for their actions. Your interactions with third parties are solely between you and them.

To the fullest extent permitted by law, MyPocketCoachAI LLC is not liable for indirect, incidental, consequential, exemplary, or punitive damages, including lost profits, personal injury, or property damage arising from use of the App or reliance on AI outputs. Our total liability for any claim will not exceed the fees you paid, if any, in the twelve (12) months before the claim arose.

14. Indemnification

You agree to indemnify and hold harmless MyPocketCoachAI LLC, its officers, employees, partners, and licensors from claims arising out of your use of the App, violation of these Terms, infringement of third-party rights, or reliance on AI-generated guidance.

15. Suspension, Termination & Changes

You may delete your account at any time. We may suspend or terminate access for policy violations, non-payment, legal requirements, or behavior that jeopardizes user safety. We may modify these Terms or the App features; continued use after notice means you accept the updated Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute, claim, or controversy will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and held in Wilmington, Delaware. The Federal Arbitration Act governs interpretation and enforcement of this provision. You waive class actions and jury trials. You may opt out of arbitration within 30 days of first accepting these Terms by emailing mypocketcoachai@gmail.com with your account details and a statement that you wish to opt out. Either party may bring qualifying claims in small-claims court in their county of residence. If arbitration is unenforceable for a claim, the dispute will be heard exclusively in the state or federal courts located in Delaware.

If you believe content within the App infringes your copyright, send a written notice that meets the requirements of 17 U.S.C. §512(c)(3) to:

Technical & Usage Data

• Device identifiers, OS, app version, IP address, locale, crash reports, and diagnostic logs.
• Feature usage analytics (e.g., AI chat volume, scan counts, reminder interactions) used to improve performance and safety.

Communications & Support

• Messages with support, survey responses, marketing preferences, and in-app feedback.

How We Use Data

• Deliver personalized workouts, nutrition plans, and AI recommendations tailored to your inputs and authorized health data.
• Operate AI Coach Chat, AI Food Scan, body analysis, and related safety systems (e.g., prompt filtering, abuse prevention).
• Sync with approved health data sources, track progress, and maintain your history across devices.
• Analyze usage patterns, detect fraudulent or unsafe activity, and improve features, models, and infrastructure.
• Communicate about security issues, product updates, billing, legal notices, and customer support.

Legal Bases (GDPR/International)

• Consent: connecting HealthKit, sharing progress photos, or opting into marketing.
• Contract: providing the App, AI experiences, and subscriptions you request.
• Legitimate interests: securing the platform, preventing abuse, researching feature adoption (balanced with your rights).
• Legal obligations: complying with tax, accounting, or regulatory reporting.

Sharing & Processors

• We do not sell personal data.
• Trusted processors—such as Anthropic/OpenAI-style AI chat providers, computer-vision vendors for AI Food Scan, HealthKit synchronization services, secure cloud hosting, analytics, and crash reporting partners—process limited data under contracts requiring confidentiality, security, and privacy safeguards.
• We may disclose information to comply with law, enforce agreements, protect users, or as part of corporate transactions (mergers, financings, or asset sales).

Sensitive Data & Consent Management

• Submitting body photos, biometrics, health history, or connecting HealthKit constitutes explicit consent for us to process that information to deliver the requested features.
• You can revoke consent at any time by disconnecting integrations, deleting uploaded media, adjusting in-app privacy settings, or contacting mypocketcoachai@gmail.com. Revocation may limit functionality but will not affect prior lawful processing.
• We do not use sensitive data for advertising or unrelated profiling and will obtain additional consent if processing purposes materially change.

Apple Health / HealthKit Statement

• HealthKit data is used solely to provide or improve health features in the App and is never used for advertising or data mining.
• We only access HealthKit categories you explicitly approve and you may revoke access at any time in Apple Health settings.
• We do not store HealthKit data in iCloud backups unless you enable it, and we do not share HealthKit data with third parties except to operate the App or with your consent.

Data Security & Retention

• Data is encrypted in transit and at rest with access limited to trained personnel.
• We retain personal data while your account is active and as required to provide services, comply with law, or resolve disputes.
• Aggregated or anonymized AI training data is retained only as needed to monitor performance and safety.

Your Rights & Choices

• Access, update, or correct your data within settings or by contacting us.
• Download a machine-readable export of your information.
• Request deletion of your account, AI chat transcripts, AI Food Scan history, or HealthKit data (subject to legal retention requirements).
• Opt out of marketing communications and revoke permissions for integrations (e.g., HealthKit) at any time.

International Transfers

We may process data in the United States and other countries where we or our providers operate. When transferring personal data from the EU/EEA, UK, or Switzerland, we rely on approved safeguards such as Standard Contractual Clauses.

HIPAA & Medical Information

MyPocketCoachAI LLC is not a covered entity or business associate under HIPAA. Our services are not intended to store or transmit Protected Health Information on behalf of healthcare providers. If you share App data with clinicians or integrate it into a medical record, ensure those disclosures comply with HIPAA or other medical privacy laws.

Children’s Privacy

The App is not directed to children under 13 (or the age required in your jurisdiction). We use age-gating and manual reviews to block underage accounts and do not knowingly collect data from children. If a child submits information, contact mypocketcoachai@gmail.com so we can delete it promptly and terminate the account.

Third-Party Links & Services

Linked services or referenced resources may point to third-party sites. Those sites maintain their own privacy practices and we are not responsible for their policies.

Changes

We may update this Privacy Policy as products, laws, or data practices evolve. Material changes will be communicated via in-app notice, email, or by updating the “Last Updated” date.
